Commercial Driver & CVOR Defense

When you drive for a living, a traffic charge is not a fine. It is your job. A conviction follows you twice: onto your own driver's abstract, and onto your carrier's CVOR, which is what dispatchers and future employers actually check. Have it reviewed before you decide anything.

Why commercial drivers face tougher consequences

The same charge that costs an ordinary driver a fine and some points can cost a professional driver their livelihood.

Employers and insurers check your driving history, and in commercial trucking even one conviction can affect whether you are dispatched, whether you are hired, and what the carrier pays to insure you. Fines for commercial vehicles are also frequently higher than for passenger cars, and some offenses carry consequences that do not exist for private drivers at all.

And a conviction lands in two places:

  • Your own driver's abstract: demerit points and a three year conviction record, exactly as for any driver
  • The carrier's CVOR (Commercial Vehicle Operator's Registration), points against the operator's safety rating, which can trigger audits, sanctions and, at the extreme, loss of the carrier's ability to operate

That second record is why a carrier will often let a driver go over a conviction that seems minor on its own. Protecting the CVOR is protecting the job.

Common commercial charges

ChargeWhy it matters for a commercial driver
Speeding & careless drivingHigher fines for commercial vehicles; heavy CVOR weighting
Overweight / over dimensionFines scale with the excess and can run into the thousands
Logbook & hours of servicePoints on the CVOR; can lead to being placed out of service
Failing to stop at a weigh scaleSerious CVOR consequence and a significant fine
Equipment & inspection defectsEach defect can be a separate charge; also affects CVOR
Wheel separation, insecure loadAmong the most heavily weighted CVOR events
The CVOR is the carrier's record, not yours: but the conviction that put the points there is yours to defend. A charge withdrawn or reduced before conviction never reaches either record.

Penalties vary widely by charge, vehicle class and circumstances. This is general guidance, not a quote for your matter.

How we approach a commercial charge

Commercial matters are often more technical than passenger car tickets, and the disclosure reflects that:

  • The specific section charged: commercial offenses are frequently laid under the wrong subsection or against the wrong party (driver vs. operator), and that matters.
  • The evidence: scale certificates, inspection reports, logbook records, speed measuring devices, and whether procedure was followed at the roadside or weigh station.
  • Resolution discussions: where appropriate, negotiating with the prosecutor to resolve the matter as a lesser offense with less CVOR weight, or none.
  • Represent you in court: filing, disclosure, the prosecutor and the hearing. Most commercial drivers cannot afford a day off the road for court, and in most cases you will not need one.

We also work with the carrier where the driver and operator are both charged, so the two defenses are consistent. No outcome is ever promised, every case turns on its own facts.

Common questions

What types of traffic violations can affect commercial drivers?

Common ones include overweight or over dimension tickets, logbook and hours of service violations, speeding, careless driving, unsafe lane changes, failing to stop at a weigh scale, and equipment or inspection defects. Any of these can add points to your abstract and to your carrier's CVOR, and can affect your employment.

What happens if I receive a commercial driving violation?

Fines are often much higher than for a passenger vehicle, and on conviction the offense is recorded on both your driver's abstract and the carrier's CVOR (Commercial Vehicle Operator's Registration). Depending on the charge that can mean demerit points, a suspension, CVOR sanctions against the carrier, and, very commonly, losing the job, because carriers manage their CVOR rating closely.

How can Fix-A-Ticket help commercial drivers?

A licensed paralegal reviews the charge and the disclosure, tests the evidence and the procedure, and where appropriate negotiates with the prosecutor for a lesser offense carrying less CVOR weight, or none. We represent you in Provincial Offences Court so you can stay on the road rather than in a courtroom. Results depend on the facts; no outcome is guaranteed.
